PHILADELPHIA – Two well-known former Democrats turned independents who are backing Donald Trump will be in the spin room at Tuesday night’s debate between the former president and Vice President Kamala Harris, to talk up Trump’s performance. Robert F. Kennedy Jr. the well-known environmental activist and vaccine skeptic who last month suspended his own presidential campaign and endorsed Trump, will be on hand at Philadelphia’s National Constitution Center, the Trump campaign confirmed to Fox News. So will former Rep. Tulsi Gabbard of Hawaii, who unsuccessfully ran for the 2020 Democratic presidential nomination before leaving the party and becoming an independent two years ago. 2024 SHOWDOWN: HARRIS AND TRUMP TO FACE OFF IN ‘DECISIVE’ DEBATE Gabbard, who’s become a favorite of many on the political right, backed Trump last month. HERE’S WHAT TRUMP ALLIES SAY THE FORMER PRESIDENT SHOULD DO IN HIS DEBATE WITH HARRIS Joining Kennedy and Gabbard in the spin room at the debate – which is the first and potentially only face-to-face showdown between Harris and Trump before Election Day on Nov 5 – is a squad of high-profile Republicans. Topping the list is Trump’s running mate, Sen. JD Vance of Ohio. Also in the spin room for Trump: Republican National Committee chair Michael Whatley and co-chair Lara Trump, who is the former president’s daughter-in-law. So will former Trump rivals during the race for the 2024 Republican presidential nomination turned surrogates: Gov. Doug Burgum of North Dakota, Sen. Tim Scott of South Carolina and Vivek Ramaswamy. Other top surrogates in the spin room will be Sens. Marco Rubio and Rick Scott of Florida, and Tom Cotton of Arkansas, Reps. Byron Donalds and Matt Gaetz of Florida and Mike Waltz of Texas, and Gov. A resurfaced American Civil Liberties Union questionnaire from when Kamala Harris was running for president in 2019 has revealed that she supports gender transition surgeries for detained migrants and that she wants to slash funding from U.S. Immigration and Customs Enforcement (ICE).  The document, which was first reported on by CNN, also asks then-Sen. Harris for her views on topics such as the U.S. prison system, D.C. statehood, abortion access and the decriminalization of drugs.  “The Vice President’s positions have been shaped by three years of effective governance as part of the Biden-Harris Administration,” a Harris campaign adviser told Fox News this week when asked about her responses.  Harris had written in the document that “Our immigrant detention system is out of control, and I believe we must end the unfair incarceration of thousands of individuals, families and children.  HARRIS FINALLY ADDS POLICY PAGE TO CAMPAIGN WEBSITE, DEVOTES SEVERAL SECTIONS TO TRUMP  “I was one of the first Senators after President Trump was elected to advocate for a decrease in funding to ICE. I have led efforts to urge the Senate Appropriations Committee to decrease detention dollars. As president, I will fight to pass my DONE (Detention Oversight Not Expansion) Act into law which would increase oversight of Immigration and Customs Enforcement detention facilities, slash detention by at least 50%, and halt funding for the construction or expansion of new facilities,” she said.  When asked by the ACLU if “as President will you use your executive authority to ensure that transgender and nonbinary people who rely on the state for medical care — including those in prison and immigration detention — will have access to comprehensive treatment associated with gender transition, including all necessary surgical care?,” Harris responded yes.  “It is important that transgender individuals who rely on the state for care receive the treatment they need, which includes access to treatment associated with gender transition. That’s why, as Attorney General, I pushed the California Department of Corrections and Rehabilitation to provide gender transition surgery to state inmates,” Harris wrote.  “I support policies ensuring that federal prisoners and detainees are able to obtain medically necessary care for gender transition, including surgical care, while incarcerated or detained. Transition treatment is a medical necessity, and I will direct all federal agencies responsible for providing essential medical care to deliver transition treatment,” she added.  YOUNG SWING STATE VOTERS DELIVER ADVICE FOR KAMALA HARRIS  Harris also indicated to the ACLU in 2019 that she would commit to ending the use of ICE detainers.  “As Attorney General, I issued a bulletin on December 4, 2012 informing all California law enforcement that they did not have to comply with ICE detainers. As president I will focus enforcement on increasing public safety, not tearing apart immigrant families,” she said.  When the ACLU asked Harris “Since drug use is better addressed as a public health issue (through treatment and other programming), will you support the decriminalization at the federal level of all drug possession for personal use?,” she also responded yes.  “Throughout my career I have supported treating drug addiction as a public health issue, focusing on rehabilitation over incarceration for drug-related offenses,” Harris said in her response.

Former President Jimmy Carter is paying close attention to the election cycle while in hospice care and grieving the loss of his wife, Rosalynn Carter, their son revealed in a recent interview.  “He does not believe Donald Trump should be president again,” James Earl “Chip” Carter III, the second child of Jimmy and Rosalynn Carter, told the Washington Post last week.  Carter, the longest-lived American president at 99, entered hospice care in February of last year, but he has remained committed to following the presidential election, his son said. Last month, the 39th president watched the speakers of the DNC, who gathered in Chicago in support of Vice President Kamala Harris and Minnesota Gov. Tim Walz’s presidential campaign.  Carter’s son said the former president believed Harris’ speech was “great,” but noted another speaker stole the show.  JIMMY CARTER, LONGEST LIVING US PRESIDENT, TURNS 99 “He thought Michelle Obama was the best, and he thought Kamala was great, too,” Chip Carter said.  Before the DNC kicked off last month and Carter diligently watched the speakers, he typically spent his days watching baseball games streamed on his TV, as well as 1950s TV shows, such as “Leave it to Beaver,” and eating mini red velvet and caramel flavored cupcakes, his family told the outlet.  JIMMY CARTER, 99, MARKS ONE YEAR IN HOME HOSPICE CARE Carter watched President Biden officially drop out of the presidential race at the end of July amid mounting concern over Biden’s mental acuity and 81 years of age, his son told the outlet. Carter looked toward his son during Biden’s address and described the 46th president bowing out in favor of a younger Democratic generation taking the mantle as “sad,” the Washington Post reported.  The former president is four-square against Trump securing a second term, his son explained, saying his father believes Trump is not truthful when he speaks publicly. Carter suffered tragedy in November, when his wife of 77 years died after she was admitted to hospice care. An Arizona law that requires residents to show proof of citizenship in order to be able to vote in elections is before the courts again on Tuesday after the Supreme Court allowed parts of the law to be enforced – and amid national concerns about noncitizen voting. Arizona’s law will be before a Ninth Circuit Court of Appeals panel on Tuesday for oral arguments over the law, which was initially blocked by a lower court earlier this year. The law would require those registering to vote to provide proof of citizenship.  The Supreme Court allowed the enforcement of restrictions that block people from voting in state and local elections, but those who have registered without that proof can still vote in presidential and congressional elections with a different federal form. That form requires them to swear they are citizens under penalty of perjury.  SCOTUS GIVES PARTIAL VICTORY TO GOP TRYING TO ENFORCE PROOF OF CITIZENSHIP TO VOTE IN ARIZONA  Justice Clarence Thomas, Justice Samuel Alito and Justice Neil Gorsuch would have granted the application in full, while Justice Sonia Sotomayor, Justice Elena Kagan, Justice Amy Coney Barrett and Justice Ketanji Brown Jackson would have denied the application in full. Chief Justice John Roberts and Justice Brett Kavanaugh provided a compromise of sorts with their deciding votes. The now-stalled 2022 state law requiring proof of citizenship was challenged by civil rights groups and the Arizona Democratic Party.  It comes amid yearslong concerns by Republicans, in particular about the potential for noncitizens voting in U.S. elections. This week, the U.S. Department of Justice said an illegal immigrant reached an agreement to plead guilty to charges related to stealing a U.S. citizen’s identity to vote in multiple elections and fraudulently obtaining an American passport.  Meanwhile, in Congress, Republicans have looked to tie a bill to require proof of citizenship before registering to vote in federal elections to a spending bill extension to avoid a government shutdown at the end of the year. The Biden-Harris administration has come out in strong opposition to the SAVE Act, making clear it would not be signed by the president if passed. “It is already illegal for noncitizens to vote in Federal elections – it is a Federal crime punishable by prison and fines,” reads a statement of administration policy last month. Arizona residents shared their views with Fox News Digital last month about whether voters should provide proof of citizenship to vote. “Absolutely,” one voter in Sierra Vista, Arizona, told Fox News Digital. “I have to provide proof of ID to get on a plane to go to New York. So why wouldn’t anybody else have to have an ID to vote for the people that are going to run our country?” ARIZONA LAW REQUIRING PROOF OF CITIZENSHIP TO VOTE SUPPORTED BY 24 STATE AGS IN EMERGENCY STAY WITH SCOTUS “I think that’s a decent idea,” one man told Fox in Tucson. “I think if it’s not there, and you don’t have you don’t have a way to prove it, then you shouldn’t be counted in the voting system,” a resident in Yuma said. “Absolutely, it’s unconstitutional otherwise,” a resident in Arivaca said. “Absolutely, yeah,” another resident in Tucson said. FIRST ON FOX: American taxpayers lost more than $100 billion to fraud and improper payments as a result of temporary unemployment insurance programs created in response to COVID-19, the House Oversight Committee found.  Fox News Digital obtained the House Oversight Committee’s report after its monthslong investigation examining fraud in pandemic unemployment relief programs.  The report details information, documents and communications obtained by the committee showing how states across the country, including California, New York and Pennsylvania, processed and administered pandemic unemployment insurance claims with “minimal oversight.”  The committee said that lack of oversight led to “billions of taxpayer dollars lost to improper and fraudulent payments that will likely never be recovered.”  CUOMO TO TESTIFY ON COVID ORDERS, NURSING HOME DEATHS AS SPOKESMAN PREDICTS A ‘MASTER CLASS IN GASLIGHTING’ The committee found that 11% to 15% of total benefits paid during the pandemic were fraudulent, totaling between $100 to $135 billion. The Department of Labor’s Office of Inspector General estimated that at least $191 billion in pandemic unemployment insurance payments could have been improperly paid, with a “significant portion attributed to fraud.”  The committee found that states have only recovered approximately $6.8 billion of those funds.  The committee also found that those receiving the benefits “did not have to provide evidence that they were actively seeking work to continue receiving benefits.”  During the first nine months of the program, claimants did not have to provide any evidence of earnings, which the committee said made the program more susceptible to fraud. In December 2020, when Congress reauthorized the program, states began to require applicants to provide proof of prior employment and wages.  The Department of Labor reported that the program had a total improper payment rate of 35.9%.  FEDS WASTED ‘AT LEAST’ $191 BILLION ON FAKE COVID UNEMPLOYMENT CLAIMS, SAYS LABOR DEPARTMENT WATCHDOG In March 2021, the Biden-Harris administration extended the pandemic unemployment insurance programs and benefits for an additional six months, even though states and businesses were open, and the vaccine rollout was underway.  “Citing labor shortages, 26 states chose to end federal benefits early citing that the exorbitant federal benefits were leading to labor shortages in those states,” the committee found.  READ THE REPORT – APP USERS, CLICK HERE: However, the committee also found that organized crime “played a major role” in unemployment insurance fraud by targeting pre-existing system vulnerabilities. “Foreign nationals, organized criminal gangs, prison inmates, and those acting on their behalf, filed fraudulent claims in multiple states,” the report states. “Insiders, including those who worked for state workforce agencies, conspired with organized crime factions and other individuals to defraud state UI programs and the states did little to stop them.”  House Oversight Committee Chairman James Comer, R-Ky., blamed the fraud on Democrats and the Biden-Harris administration, saying they “spent trillions of dollars under the guise of pandemic relief.”  Comer said his committee’s first hearing on the matter exposed how “unchecked spending left taxpayer funds, including UI programs, vulnerable to significant waste, fraud, and abuse.”  CALIFORNIA, NEW YORK, ILLINOIS USED COVID-19 RELIEF FUNDS TO PUSH CRT IN SCHOOLS “While Democrats turned a blind eye to this waste of taxpayer dollars, Republicans were committed to identifying how these taxpayer funds fell prey to fraudsters and criminal organizations,” Comer said.  Comer said his committee’s report includes recommendations to ensure future taxpayer-funded UI programs “don’t suffer a similar fate.”  “Rooting out waste, fraud, abuse, and mismanagement in the federal government remains a top priority for Oversight Republicans, and we will continue to work to protect all American taxpayers,” Comer said.  The committee recommends that for future UI benefits programs, the government must require claimants to provide their proof of work before their claims are reviewed for eligibility.  “Unemployment insurance should always be tied to work,” the report states.  The committee also recommends that future programs “require state workforce agencies to cross-check” claimants across federal databases – including federal prisoner databases.  Meanwhile, the committee recommended Congress consider extending the statute of limitations for the fraud programs associated with the pandemic UI programs, which are due to expire in March 2025, so that criminals that defrauded taxpayers may be brought to justice.

Jon Tester, D-Mont., on Tuesday, specifically attacking his record on gun rights. “Where I live, you can’t wait for 911. My family’s safety is in my hands alone,” a female narrator says in a new ad from the NRA’s political action committee, the NRA Political Victory Fund. DEMS FACE TIGHT TIMELINE TO CONFIRM BIDEN-HARRIS JUDGES, SURPASS TRUMP LEGACY The video depicts a would-be intruder approaching a home with a woman alone inside who grabs her firearm when she realizes someone is outside. The narrator says Tester “failed to protect my right to self-defense.” “And that’s why moms like me can’t wait to fire him in November,” she continued. The more than $2 million reservation will be seen across the Big Sky State and will also reach Montana voters on digital platforms, through text and direct mail components. The expenditure is the NRA Political Victory Fund’s first television ad of the cycle. MCCORMICK SAYS ‘PEOPLE ARE RECOGNIZING’ IMPORTANCE OF 2024 ELECTION AS PENNSYLVANIA SENATE POLLS TIGHTEN According to the PAC, the ad was filmed on location and also features a real Montana mother.  “This November, gun owners can’t afford to sit on the sidelines,” Randy Kozuch, chair of the NRA Political Victory Fund, said in a statement.  “With this seven-figure ad buy, only a portion of our electoral engagement in Montana, we are calling out Jon Tester,” he said.  POLITICAL HANDICAPPER SHIFTS MONTANA SENATE TO ‘LEANS REPUBLICAN’ AS TESTER FALLS BEHIND Per Kozuch, Tester’s “voting record in the Senate makes clear he is not on the side of Montanans who support the 2nd Amendment.” He specifically pointed to Tester’s support for “anti-gun” Supreme Court justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson.  “He has voted to spend taxpayer dollars to promote state-level red flag laws, which are ripe for abuse, and deny gun owners basic due process protections. And he’s voted multiple times to criminalize private firearms transfers while supporting government blacklists,” he said.  The Montana Democrat notably voted in favor of bipartisan gun legislation in 2022 that made millions of dollars in grant funding available to states for the purpose of enforcing protection orders for those deemed to be extreme risks, colloquially referred to as “red flag laws.” The grants also assist states in closing what’s referred to as the “boyfriend loophole,” expanding limits on firearm ownership for domestic abusers to a variety of relationships, as opposed to only spouses.  Fifteen Republicans joined Senate Democrats at the time to support the bill. However, the majority of the GOP conference did not back the measure.  SENATE GOP BRACING FOR LAST-MINUTE LEADER BIDS – POTENTIALLY BY KEY TRUMP ALLY Tester campaign spokesperson Monica Robinson told Fox News Digital in a statement, “As Tim Sheehy himself said, ‘I’m not the biggest fan of the NRA, because I don’t think the NRA is really, truly worried about Second Amendment rights.’ There’s one champion who has always defended Montana gun owners, and that’s Jon Tester, who is a proud gun owner himself.” Robinson was referencing a June Politico report that Sheehy was skeptical about the NRA’s interests during an event last year. A Sheehy spokesperson responded at the time, pointing to the fact that he is a “political outsider who calls it like he sees it.” In a statement to Fox News Digital, a spokesperson for Sheehy’s campaign said, “The choice is clear this election. Tim Sheehy is A rated by the NRA because he’ll always protect our Second Amendment rights and Jon Tester is F rated by the NRA because he supports the Obama-Biden-Harris radical liberal gun control agenda.” The Montana Senate seat is considered Republicans’ No. 1 target in the upcoming Senate elections, aside from West Virginia, which is expected to easily turn red after independent Sen. Joe Manchin’s retirement. Tester’s race is also believed to be the Senate GOP’s key to the majority in 2025.  A top political handicapper, the Cook Political Report, has long rated the race between Tester and former Navy SEAL Tim Sheehy as a “toss up.”  However, another respected handicapper recently shifted the matchup to “leans Republican.” Sabato’s Crystal Ball at the University of Virginia’s Center for Politics explained the change, pointing to a new poll from the AARP showing Sheehy with a six-point 51%-45% advantage over Tester in a two-way race.  In an expanded field, Sheehy still defeated Tester, 49%-41%. Former President Trump and Vice President Harris are neck and neck ahead of their first – and potentially only – debate in Philadelphia on Tuesday, according to a new survey of voters that has some pollsters seeing a “warning sign” for Democrats. Harris leads Trump 49% to 48% among registered voters, showing a race that has tightened since August when Harris held a 3-point lead against Trump, according to an NPR/PBS News/Marist National Poll released Tuesday morning. Among those who say they definitely plan to vote, the survey found Harris edging Trump by 3 points, 51% to 48%. Trump, however, leads Harris among Independent voters 49% to 46% – a 14-point shift from August when Harris commanded an 11-point lead in a field that had multiple candidates, such as Robert F. Kennedy Jr., the poll found. LIVE UPDATES: KAMALA HARRIS, DONALD TRUMP MEET IN PHILADELPHIA FOR PRESIDENTIAL DEBATE TONIGHT Republican pollster Whit Ayers told PBS News that the swing in independent support is a “warning sign” for Harris’ campaign. “She had the honeymoon period,” Ayers said of the initial excitement that Harris generated among Democrats after President Biden exited the race. The latest results of the New York Times/Siena poll released on Sunday also found the two candidates locked in a dead heat. In that poll, Trump seemingly shrugged off a burst of enthusiasm for Democrats after Harris entered the race, garnering the support of 48% of likely voters, compared to 47% who indicated support for the vice president.  NEW POLL SHOWS TRUMP HOLDS LEAD WITH ‘REMARKABLY RESILIENT’ SUPPORT The NPR/PBS News/Marist National Poll also showed Trump up with Latinos voters 51% versus 47% for Harris, a 9-point swing since August. On the issues, the survey found that a majority of Americans consider Trump better equipped to handle the immigration crisis (53% to 46%), the economy (52% to 48%) and the Middle East (51% to 47%). Harris, however, is perceived as the candidate to better handle the abortion issue, 56% to Trump’s 42%. Republican strategist Kevin Madden told PBS News that Harris’ initial surge of support and enthusiasm was an “enormous sugar high” because she was “a new candidate not named Trump or Biden.” Now, Madden says recent polling shows that burst of excitement subsiding. “This race has snapped back to where it always was, which is a very, very close contest, amongst a very bitterly divided electorate, and that this election is going to be very, very close and it’s going to come down to a few hundred thousand voters in a handful of states,” Madden told the outlet.
