Trump holds 4-point lead over Biden in Michigan, poll shows
A new poll released over the weekend shows former President Trump holding a four-point lead over President Biden in Michigan. The EPIC-MRA poll, released Saturday, shows that in a matchup between Trump and Biden, 49% of survey respondents said they would vote for the Republican and 45% said they would vote for the Democrat. The survey, with a margin of error of plus or minus 4%, was conducted between June 21 and June 26, days before Biden’s widely criticized debate performance. Favorability for Trump and Biden dipped slightly when third-party candidates were factored in. Trump dropped to 41% and Biden to 38%. It was overshadowed by Thursday’s presidential debate that had even die-hard Biden supporters panicking over the president’s ability to beat Trump in November. Many have called for Biden to step aside, though there is no indication that he is willing to do so. Flash polls from CNN and Ipsos on Friday called Trump the clear victor of the debate. Justices claim immunity ruling allows presidents to poison staff, have Navy SEALs kill political rivals
In their dissents from the Supreme Court’s decision on presidential immunity, the court’s liberal justices suggested that the majority opinion allows for a slew of alarming scenarios — including a president ordering a Navy SEAL team to “assassinate” his political rival or even poisoning one of his own cabinet members. The high court on Monday ruled 6-3 that a president has substantial immunity for official acts that occurred during his time in office. It’s a decision that has significant implications for former President Trump, whose prosecution on charges related to the Jan. 6 U.S. Capitol breach and alleged 2020 election interference spurred the Supreme Court to hear the case. But although the majority opinion from Chief Justice John Roberts explicitly stated that the president “is not above the law” and immunity is only a factor when it involves an “official act” — the justices sent the case back to lower courts to determine if the acts at the center of Trump’s case were “official” — the ruling raised a series of frightening possibilities, according to the trio of dissenting justices. Justices Sonia Sotomayor, Ketanji Brown Jackson and Elana Kagan wrote in the primary dissent that the court’s majority opinion “makes a mockery of the principle, foundational to our Constitution and system of Government, that no man is above the law.” TRUMP IMMUNITY CASE: SUPREME COURT RULES EX-PRESIDENTS HAVE SUBSTANTIAL PROTECTION FROM PROSECUTION “The President of the United States is the most powerful person in the country, and possibly the world. When he uses his official powers in any way, under the majority’s reasoning, he now will be insulated from criminal prosecution,” Sotomayor wrote. “Orders the Navy’s Seal Team 6 to assassinate a political rival? Immune. Organizes a military coup to hold onto power? Immune. Takes a bribe in exchange for a pardon? Immune. Immune, immune, immune.” She continued: “Let the President violate the law, let him exploit the trappings of his office for personal gain, let him use his official power for evil ends. Because if he knew that he may one day face liability for breaking the law, he might not be as bold and fearless as we would like him to be. That is the majority’s message today.” Sotomayor added that the majority decision has “shifted irrevocably” the relationship between the president and the American people, being that “in every use of official power, the President is now a king above the law.” BIDEN CAMP DISMISSES TRUMP IMMUNITY RULING: ‘DOESN’T CHANGE THE FACTS’ Yet another startling scenario is included in a footnote from a separate dissent authored by Jackson. Noting that the president’s removal of a cabinet member would constitute an official act, Jackson says that “while the President may have the authority to decide to remove the Attorney General, for example, the question here is whether the President has the option to remove the Attorney General by, say, poisoning him to death.” She adds: “Put another way, the issue here is not whether the President has exclusive removal power, but whether a generally applicable criminal law prohibiting murder can restrict how the President exercises that authority.” Sotomayor’s conclusion summed up the prevailing tenor of her and Jackson’s writings: “With fear for our democracy, I dissent.” Both dissents were taken to task in the court’s majority opinion. “As for the dissents, they strike a tone of chilling doom that is wholly disproportionate to what the Court actually does today…,” Roberts wrote. He added: “Coming up short on reasoning, the dissents repeatedly level variations of the accusation that the Court has rendered the President ‘above the law.’” TRUMP TOUTS SUPREME COURT’S PRESIDENTIAL IMMUNITY RULING AS ‘BIG WIN FOR OUR CONSTITUTION AND FOR DEMOCRACY’ Adding that the dissents came “up short on reasoning,” Roberts wrote that the “positions in the end boil down to ignoring the Constitution’s separation of powers and the Court’s precedent and instead fear mongering on the basis of extreme hypotheticals about a future where the President ‘feels empowered to violate federal criminal law.’” Sotomayor’s dissent swiftly reverberated throughout social media. Former Secretary of State Hillary Clinton, who lost to Trump in the 2016 election, posted on X that she agrees with Sotomayor’s stand against the “MAGA wing” of the high court. “It will be up to the American people this November to hold Donald Trump accountable,” Clinton wrote.
Democrats’ nomination of Biden in virtual roll call could come as early as mid-July
The Democratic National Committee is considering formally nominating President Biden as early as mid-July, two Democratic sources confirm to Fox News. A potential date for Biden’s nomination is July 21, which is when the Democratic National Convention’s credentials committee meets virtually. As has been reported for weeks, Democratic Party officials decided that the formal roll call would not take place at their convention, which kicks off on August 19th in Chicago. BIDEN TRIES TO FLIP THE SCRIPT ON THE NEGATIVE NARRATIVE COMING OUT OF THE DEBATE The reason is that the Democrats’ convention comes after Ohio’s ballot deadline of August 7th. Party officials, in a maneuver to allow Biden to appear on the Ohio ballot, said they would hold the roll call ahead of Ohio’s ballot deadline. But the latest development on a potential July 21 roll call date also comes in the wake of last Thursday’s disastrous debate performance by the president in his first face-to-face showdown with former President Trump. The 81-year-old president’s halting delivery and stumbling answers at the debate sparked widespread panic in the Democratic Party and spurred calls from political pundits, editorial writers, and some party politicians and donors, for Biden to step aside as the party’s standard-bearer. Newsom to headline Democratic campaign event in New Hampshire
California Gov. Gavin Newsom is headed to New Hampshire this week to headline a Democrat campaign event just days after the Biden-Trump presidential debate, fueling more speculation that he may be preparing to step in if Biden backs out of the 2024 race. The event, called the “Blue Summer Campaign Kick-Off,” will be spearheaded by the New Hampshire Senate Democratic Caucus on July 8. “I will never turn my back on President Biden,” Newsom told reporters in the spin room following Thursday night’s debate, appearing to dispel rumors that he’s running a shadow campaign. “I don’t know a Democrat in my party that would do so. And especially after tonight, we have his back.” Newsom assured reporters that he was not going to turn his back on Biden — who has faced significant criticisms and conerns over his mental acuity — and was confident he was fit to be the country’s leader. FIRST 2024 TRUMP-BIDEN PRESIDENTIAL DEBATE: TOP CLASHES OVER ISSUES FROM THE BORDER TO UKRAINE “I spent a lot of time with him. I know Joe Biden. I know what he’s accomplished in the last three and a half years. I know what he’s capable of. And I have no trepidations,” Newsom said. Leading up to the debate, rumors continued to swirl that Newsom, a possible candidate for president in 2028, had been tapped as a Biden surrogate leading up to the November presidential election. When pressed if he was “ready to take on Donald Trump,” hinting that he could be a potential replacement for Biden, Newsom again denied the rumors and gave his full support to the president. Last year, Biden told a group of world leaders that California Gov. Gavin Newsom “could have the job I’m looking for” if he wanted, amid a low approval rating and discontent within his own party. FETTERMAN HITS NEWSOM FOR NOT HAVING ‘GUTS’ TO ADMIT HE’S RUNNING SHADOW CAMPAIGN AGAINST BIDEN “I want to talk about Governor Newsom. I want to thank him. He’s been one hell of a governor, man,” Biden said during a welcome reception for Asia-Pacific Economic Cooperation (APEC) leaders in San Francisco. “Matter of fact, he could be anything he wants. He could have the job I’m looking for.” Biden’s eyebrow-raising comment was made at “the most significant event with world leaders in San Francisco in recent history,” according to the APEC 2023 website for the event. Sen. John Fetterman, D-Pa., also accused Newsom of running a shadow campaign for the presidency last year, roughly around the same time that Newsom debated against Republican Gov. Ron DeSantis hosted by Fox News’ Sean Hannity. “Let me say something that might be uncomfortable,” Fetterman said at a Democratic Party dinner in Iowa. “Right now there are two additional Democrats running for Pennsylvania, excuse me, running for president right now. One, one is a congressman from Minnesota. The other one is the governor of California. Anna Paulina Luna calls for $10,000 per day fine on Garland for Biden-Hur audio tape
Rep. Anna Paulina Luna, R-Fla., is now threatening to force a vote on a measure to impose a $10,000 per day fine on Attorney General Merrick Garland for every day he does not turn over audio tapes of Special Counsel Robert Hur’s interview with President Biden. Luna said she would force a vote on her inherent contempt resolution against Garland on Friday, but a source familiar with the matter said she agreed to delay that move after a conversation with Speaker Mike Johnson, R-La. Luna later confirmed on X, formerly Twitter, that she intends to call up that vote next week. Inherent contempt is a rarely-used congressional maneuver that would effectively allow the House to try and convict Garland. She filed a new resolution to both hold Garland in inherent contempt and fine him for the tapes on Friday, and is expected to declare the measure “privileged” when the House is back in session on July 8. DOJ WON’T PROSECUTE AG GARLAND FOR CONTEMPT FOR REFUSAL TO TURN OVER AUDIO FROM BIDEN, HUR INTERVIEW Deeming a resolution “privileged” forces the House to take it up within two legislative days. Fox News Digital reached out to Johnson’s office for further comment. While Luna had been prepping her inherent contempt resolution for some time, the added threat of fines comes after Biden’s disastrous debate performance against former President Trump on CNN last Thursday. The 81-year-old president spoke with a hoarse voice, reportedly due to a cold, and stumbled over his own answers several times during the primetime event. Viewers also observed him appearing tired and noticeably less sharp than he looked the last time he faced Trump in 2020. DOJ WON’T PROSECUTE AG GARLAND FOR CONTEMPT FOR REFUSAL TO TURN OVER AUDIO FROM BIDEN, HUR INTERVIEW It’s prompted new pushback from Republicans and even fear among some Democrats that Biden may not be fit for another four years in the White House. House Republicans, some of whom long held that Biden is not mentally fit for office, voted to hold Garland in contempt of Congress last month for his refusal to turn over audio tapes of Hur’s interview with Biden on his handling of classified documents. The Department of Justice (DOJ) has refused to prosecute, citing Biden’s decision to call executive privilege over the tapes. Biden’s counter is that the full transcript is already available – he has bashed the GOP effort as nakedly partisan. EX-REP. CHARLIE RANGEL, 94, QUESTIONS WHETHER BIDEN BELONGS IN NURSING HOME, NOT WHITE HOUSE But Republicans argue that the tapes would provide necessary context about Biden’s mental acuity that could not be gleaned from the transcript. The House GOP also sued Garland on Monday in order to obtain the tapes, with the lawsuit being led by House Judiciary Chairman Jim Jordan, R-Ohio. Fox News Digital was first to report that Luna informed colleagues last week that she intends to force a vote on holding Garland in inherent contempt. The little-known maneuver, not used since the 1930s, would direct the House sergeant-at-arms to detain Garland for a House-led trial. It’s never been invoked on a Cabinet official, but the Supreme Court upheld Congress’ ability to use it in 1935.
Whitmer claims those who think Biden can’t win Michigan are ‘full of s—’
Michigan Gov. Gretchen Whitmer took to social media to call out critics who say President Biden cannot win the swing state of Michigan. “Anyone who claims I would say that we can’t win Michigan is full of shit,” Whitmer said in a post on X Monday. “Let’s go.” The post comes after a Politico report Monday detailing a call between Michigan’s Democratic governor and Biden’s campaign, with Whitmer allegedly telling the president’s camp that her state could not be won after Biden’s poor performance in last week’s debate. BIDEN’S INNER CIRCLE SILENT AS PARTY REELS FOLLOWING ‘EMBARRASSING’ DEBATE PERFORMANCE The call, which Politico reported was between Whitmer and Biden campaign Chair Jennifer O’Malley, centered around frustration Whitmer had that she was now being raised as a possible replacement for Biden in the race after his debate performance. A source told Politico that Whitmer disavowed any effort to force Biden out of the race, though another source added that the governor warned the campaign she believed the state was no longer winnable for the president. The apparent call echoed the reaction of many Democrats after Biden’s debate performance, which immediately set of a wave of concern that the president is too old and weak to compete with former President Trump in November. Pressure mounts on battleground state Dems after Biden debate disaster
Democrats in tough swing state races are being confronted with President Biden’s weak debate performance last week and what it means for their respective races, given their connection to him. “They will hide from it until all this ‘Biden should drop out’ chatter comes to some sort of conclusion,” Republican strategist David Kochel predicted. Biden’s showing during the matchup with Trump was immediately panned, with reports quickly emerging about Democratic panic. There appeared to be near universal agreement, across ideological lines, that the president did not do well. GOP SENATE CANDIDATE TIES OPPONENT TO BIDEN DEBATE: BOB CASEY KNEW “You know they’re all scared s——- but I think most smart [politicians] understand that it is the president’s decision how to proceed following that debate disaster,” Kochel said of Senate Democrats facing tough re-election battles. Five incumbent Democratic senators are in the most competitive races of the cycle, with nonpartisan political handicapper the Cook Political Report rating the seats of Sens. Jon Tester, D-Mont., Sherrod Brown, D-Ohio, and Jacky Rosen, D-Nev., as “Toss Ups.” CONGRESSIONAL DEMS BLAST RULING ON TRUMP IMMUNITY: ‘EXTREME RIGHT-WING SUPREME COURT’ Sens. Bob Casey, D-Pa., and Tammy Baldwin, D-Wis., are in races considered “Lean Democratic.” While the five senators are unlikely to step out of line and call on Biden to drop out, “I’m sure some of these folks have their fingers crossed that Biden gets out,” Kochel claimed. The National Republican Senatorial Committee (NRSC) was quick to tie the vulnerable Democrats and others running for open seats to Biden, highlighting their past assurances of the president’s ability to lead the country for another four years. TRUMP ALLIES CELEBRATE BLOW TO ‘SENSELESS LAWFARE’ IN SUPREME COURT IMMUNITY DECISION “Democrats created this disaster by propping up Joe Biden for years despite his obvious mental decline. Now they’ve thrown the country into a national crisis. Every Democrat must answer whether they think Joe Biden can continue to serve as President of the United States – they owe their country an explanation,” NRSC spokesman Philip Letsou said in a statement. According to Sean Brown, vice president of Axiom Strategies, “Self interest and preservation will be the ultimate motivator.” BALANCE OF POWER: DEM REP SAYS PEOPLE WILL ‘WANT TO TALK ABOUT’ BIDEN STATUS ON TICKET AFTER DEBATE “As Biden’s mental capacity is in question and the discussion of whether Democrats keep him as the nominee continues, Democrats in swing states will be forced to make a clear distinction from Joe,” he explained. “The ultimate problem for them is there is not a positive message from four years of a Biden presidency for Democrats to talk about instead.” Republican strategist Cody Hall agreed the negative attention on Biden puts each of the vulnerable incumbents in a poor position going into their elections. “Jon Tester, Sherrod Brown, Tammy Baldwin and Bob Casey would rather have a potted plant than Joe Biden at the top of the ticket right now,” he said. He added that “each of them will be answering for a president the American people know isn’t up to the job and a left-wing agenda that is making it hard for families across the country to make ends meet.” What the Democrats are expected to rely on to survive these races is running against Trump, rather than with Biden. “Running with Biden is unsustainable,” said GOP strategist John Feehery. “They will say that the best way to preserve democracy is to act as a check on Trump’s power,” he predicted.
Longtime Biden Senate colleague calls for ‘new candidate’ after Biden debate performance: ‘Disaster’
Former Iowa Senator Tom Harkin, who served with President Biden in Congress for over 20 years, is calling on Democrats to pressure the president into bowing out of the 2024 race following his widely panned debate performance. Harkin told Julie Gammack’s Iowa Potluck following the debate that voter perception is that Trump is the candidate best “able to take command of a situation and control the outcome.” “Of course, Trump’s answers were meandering, gobbledygook, and full of lies, BUT they were said with force and directness,” the 84-year-old Harkin said. “I also think all incumbent Democratic Senators should write to Biden asking him to release his delegates and step aside so the convention can choose a new candidate,” Harkin added. “A couple of Governors may need to do the same.” BIDEN CAMPAIGN STAFFER REPORTEDLY ATTEMPTED TO SHUT DOWN INTERVIEWS CRITICAL OF THE PRESIDENT: ‘STOP IT HERE’ “Last night was a disaster from which Biden cannot recover,” Harkin said. The Iowa Democrat said that the president “has gone downhill since his State of the Union speech.” “Look how he walked and handled himself on the House floor even after the speech, and watch how he walks and uses his arms now,” Harkin said. “Startling!” THE PHILADELPHIA INQUIRER CALLS ON DONALD TRUMP TO DROP OUT AFTER DEBATE PERFORMANCE Harkin’s comments come after Biden’s performance in the CNN presidential debate on Thursday that immediately sparked calls from within the Democratic Party for Biden to drop out of the race over age concerns. Other Democrats, including Former Speaker Nancy Pelosi and House Majority Whip James Clyburn have rallied behind the president saying his poor performance was due to “preparation overload.” The Biden campaign did not immediately respond to a request for comment from Fox News Digital. “Folks, I know I’m not a young man,” a Biden campaign ad following the debate said. “But I know how to do this job. I know right from wrong. I know how to tell the truth,” “And I know, like millions of Americans know, when you get knocked down, you get back up.”
ACLU sues Pennsylvania county over rejected mail-in ballots
The American Civil Liberties Union says it has filed a lawsuit against Washington County in Pennsylvania, alleging that 259 eligible voters have been “disenfranchised” after not being informed of errors that disqualified their presidential primary mail-in ballots. The lawsuit, filed on behalf of seven voters, the Washington Branch NAACP and the Center for Coalfield Justice – an environmental group – comes following the Washington County Board of Elections’ “decision before the 2024 primary election to conceal from voters errors they had made on their mail ballot return envelopes that meant their votes would not be counted,” according to the ACLU. “Because the voters were not informed of the errors, they had no opportunity to correct them by either requesting a new mail ballot or by voting a provisional ballot at their polling place,” the ACLU said in a statement. A spokesperson for Washington County did not immediately respond to a request for comment Monday from Fox News Digital. ARIZONA ELECTION WORKER SEEN STEALING FROM SENATE SECURITY DESK A DAY BEFORE ELECTION CENTER THEFT, OFFICIALS SAY The lawsuit, filed in Washington County’s Court of Common Pleas, says the case is “about fundamentally unfair and egregious conduct by the Washington County Board of Elections that rises to the level of a procedural due process violation of the Pennsylvania Constitution.” “In April 2024, the Washington County Board of Elections voted 2-1 to adopt a mail-in voting policy that deliberately concealed information about which voters had made disqualifying errors on their mail-in ballot envelopes,” it says. “The Board’s decision was a complete reversal of its prior policy of notifying voters of ballot envelope mistakes – such as missing signatures or incomplete dates – and providing them with an opportunity to correct those errors.” “Instead, in the weeks leading up to the April 2024 election, the Board determined which mail-in ballots would not be counted, and then implemented a systematic process to keep that information from voters and the public, in many cases affirmatively misleading voters into thinking that their mail-in ballots would be counted,” the lawsuit continues. CALIFORNIA CITY KEEPS CONTROVERSIAL LANGUAGE ON BALLOT MEASURE FOR NON-CITIZENS TO VOTE It alleges that the Board “deliberately entered information into Pennsylvania’s Statewide Uniform Registry of Electors (“SURE”) system that made it appear as if the Board had accepted the defective mail ballots, when in fact the Board had already set them aside and was planning to not count them” and then “instructed its election office staff not to provide any information to voters who inquired about the status of their mail-in ballot, including whether they had made errors that would prevent their vote from being counted.” The ACLU says the plaintiffs involved in the lawsuit are seeking a court order for the county to stop “conceal[ing] information about voters’ errors on their mail-in ballot return packets,” and enter the appropriate data in future elections into the state’s system “that will allow voters to be automatically notified about disqualifying mistakes related to their mail-in ballot prior to Election Day.”
