House Judiciary Committee Chairman Jim Jordan, R-Ohio, has subpoenaed the Biden-Harris administration for the cost the federal government has spent on housing illegal immigrants at taxpayers’ expense. In a letter Tuesday, Jordan demanded Health and Human Services (HHS) Secretary Xavier Becerra answer about the Biden-Harris administration’s “enforcement of federal immigration law and its implementation of policies that prioritize illegal aliens and refugees over U.S. citizens and other legal residents.” Since July, Jordan said the committee, which conducts oversight over the Office of Refugee Resettlement (ORR), a component entity of HHS, has sought information about ORR’s coordination with the State Department, the Department of Housing and Urban Development (HUD) and the Department of Homeland Security (DHS) to “use taxpayer dollars to pay for housing assistance for aliens in the country.” The committee has also sought information about ORR’s relationship with Church World Service, a faith-based non-profit organization, and the organization’s Refugee Housing Solutions, “through which aliens can be connected with housing resources,” the letter says. I don’t want everybody to know who I’m voting for, but I’m going to vote for Trump,’” Green told Fox News Digital in a Zoom interview this month. Vince Sardo, a retired firefighter and former union boss of the Dunmore Firefighters IAFF Local 860, told Fox News Digital in a separate interview he also believes many of his Democrat friends and neighbors will vote for Trump without fanfare or changing their political affiliation. “I have many friends that are registered Democrats, I’m not going to mention names, but some of them are Democratic leaders in communities, and they’re voting for Trump,” the formerly longtime registered Democrat told Fox News Digital in a Zoom interview. ‘VINDICTIVE’: DEMOCRAT IN TIGHT SENATE RACE BLASTED BY GOP RIVAL FOR SWIPE AT MCDONALD’S AFTER TRUMP VISIT Political eyes are locked on Pennsylvania as the state that will likely determine the outcome of the election. Trump and Harris have both repeatedly zigzagged the state campaigning in recent weeks, while voter registration for the state released this week shows sizable shifts benefitting the GOP in the final stretch of the election cycle. Following the close of voter registration in Pennsylvania on Monday, the Democratic Party accounts for nearly 44% of registered voters compared to the GOP’s 40% but has seen its advantage over Republicans dwindle this year. President Biden won the state in 2020 by 1.17 percentage points. That year, Democrats had a larger margin of registered voters compared to their Republican counterparts, at 4.2 million to 3.5 million. The data show that Democrats had a registration advantage over Republicans by 685,818 voters during the election that Biden won by 80,555 votes. The GOP has whittled down that lead this year to a 297,824 margin. When comparing registered voters this election year to 2020, Democrats face a net loss of 257,281 voters, while Republicans have a net gain of 428,537 registered voters. More than double the number of previously registered Democrats changed their party affiliation this cycle compared to the number of registered Republicans who left the party: 54,668 registered Democrats changed their party affiliation compared to 25,634 Republicans, Pennsylvania Department of State data shows. “I don’t think it’s going to be quite as close as they’re saying. I mean, both sides are going to say that because you always play like you’re behind. That just goes with campaigning. I just see too much momentum for Trump. We won’t know that night, because in Pennsylvania we’re so slow,” Kveragas said. Fox News Digital spoke with the three Pennsylvania voters about their voting history and found that each individual had deep ties to the Democratic Party before registering as a Republican – or in Kveragas’ case, registering as a Republican in the 1990s, before registering as an Independent when Mitt Romney was at the top of the GOP presidential ticket in 2012. Green told Fox News Digital that she was raised in a Catholic, Democratic household in Pennsylvania, similar to many people across the commonwealth back in the 1960s and 1970s. Next month, North Carolinians will decide whether “only” U.S. citizens are eligible to vote in future state elections. House Bill 1074, referred to as the “Citizen Only Voting” amendment, would clarify the state’s constitution to read that “only a citizen” is allowed to vote in the Old North State. North Carolina law currently reads that “every person born in the United States and every person who has been naturalized, 18 years of age, and possessing the qualifications set out in this Article, shall be entitled to vote at any election by the people of the State, except as herein otherwise provided.” While the state already does not allow noncitizens to vote, proponents say the amendment establishes confidence in elections amid the ongoing immigration crisis. BALANCE OF POWER: HELENE COULD SHIFT POLITICAL WINDS TOWARD TRUMP, NORTH CAROLINA LAWMAKERS SAY The amendment, if passed, would adjust the wording to say that “only a citizen of the United States who is 18 years of age and otherwise possessing the qualifications for voting shall be entitled to vote at any election in this State.” ‘MOMALA’ HARRIS COUNTS ON DURHAM, NC, TECH MILLENIALS WHO WANT TO TURN US INTO SF “Ensuring that only U.S. Citizens in North Carolina can vote is a critical step that is needed in order to have confidence in our elections,” North Carolina GOP Chairman Jason Simmons wrote in a press release after the amendment was officially placed on the 2024 ballot. Other supporters of the amendment say it is a matter of prevention. “Democrats in far-left cities and states are doing everything they possibly can to allow noncitizens to vote in elections. The best defense we can mount against these attacks on democracy is to empower the people of North Carolina to amend their own constitution to state that only U.S. citizens shall vote in our elections,” State Sen. Brad Overcash, R-Gaston, said of the amendment. However, the amendment has received pushback from critics who say it is “an unnecessary and anti-immigrant tactic that will further marginalize North Carolina’s immigrant communities.” “As an immigrant to North Carolina who went through the grueling process of naturalization so that I could become a citizen and participate in democracy by voting, I fear that this proposed change in the language of our constitution is a stepping stone to further disenfranchising and disempowering us and our communities,” said Jasmina Nogo, staff attorney with the Immigrant & Refugee Rights Project at the NC Justice Center. There are roughly 1.4 million active registered voters in Clark County, Nevada, including about 450,000 Democrats, 350,000 Republicans and more than 500,000 voters who identify as nonpartisan, Independent, or Libertarian, which makes up about 70% of the voters in the state of Nevada. Former Democratic presidential candidate Hillary Clinton won Clark County by 10 points in 2016, and President Biden won by about the same margin in 2020. The Democratic candidates won Nevada overall those years by less than three points, and former Presidnet Donald Trump’s ability to narrow the gap in Clark County will play a key role in his chances to become the first Republican to win Nevada since former President George W. Bush in 2004. Union workers employed by hotel casinos in Las Vegas, who work for unions that typically endorse and canvas for Democrats, play a significant role in Clark County elections. TRUMP WITH SLIGHT EDGE OVER HARRIS IN THIS CRUCIAL WESTERN BATTLEGROUND: POLL Fox News Digital spoke with two of those union members earlier this month, when both said that housing costs are a key issue for them. “I will be a first-time home buyer. I want to keep my son in a house…I don’t want to be rent to rent, that’s one of the biggest issues right now here I would say in Nevada,” Lino Paredes, a member of the Culinary Workers Union which endorsed Vice President Kamala Harris, said, adding that he supports Harris’ proposed program to help with down payments for houses. “And then, with these prices, you know, price gouging from these corporations. They’re not helping us at all, so we’re asking, and we’re looking for someone that is willing to help…she’s a very talented woman, and so I think that she will lead this country.” Nevada GOP Chair Michael McDonald recently told Fox News Digital that the enthusiasm for the Republican ticket in Nevada, specifically Clark County, is more than he has ever seen and suggested that Trump will be successful courting union voters with his platform that includes eliminating taxes on tips. ‘SHE HASN’T DONE ANYTHING’: NEVADA VOTERS FRUSTRATED WITH BIDEN-HARRIS BORDER POLICY AS ELECTION LOOMS “I think the energy has risen,” McDonald said. “You could call for a rally, you’re talking about 5,000 people who get turned away because there’s just no room. You’re talking about people that when you call for volunteers, they’re all over the place. Our walkers, we don’t have just members. We have teams that are going out which we’ve never seen before.” Jon Ralston, CEO and editor of The Nevada Independent, told Spectrum News 1 that Trump’s position on taxing tips could be significant in Clark County. “Trump is really using that as his signature issue here,” Ralston said. “If he can penetrate past the leadership, into the rank-and-file, and divide them a little bit, that could cut down the Democratic margin in Clark County and that’s how he could win the state.” “And you know, the Democrats, they have union workers that are being paid to walk out as volunteers. And we have teams now that you’ve never seen before. So the energy and enthusiasm is right in our wheelhouse.” Early voting in Nevada began last weekend, and the Las Vegas Review-Journal reported that out of the voters who cast their ballots on the first day in Clark County, 49.2% were Republicans, 30.5% were Democrats and 20.2% were Independents. On Thursday, Ralston reported that Republicans have a statewide early voting lead of 17,000 in Nevada, with Democrats leading in Clark County by just under 7,000. In addition to the presidential race, Clark County will also play a key role in determining who the next senator of Nevada is, as incumbent Jacky Rosen faces a challenger from Republican war veteran Sam Brown. Fox News Digital recently reported that Brown has narrowed the gap with Rosen with less than two weeks to go before Election Day. “The number-one issue that folks have been worried about for the last couple of years has been the economy and how this Biden-Harris economy has put so much pressure on individuals, on families,” Brown recently told Fox News Digital at an event with GOP Sen. John Kennedy in Las Vegas. Polling shows Trump making historic gains with Hispanic voters compared to previous Republican candidates. Competitive Virginia House race tied as Republican incumbent battles challenger

A red-leaning House race in Virginia has become more competitive, as the Republican incumbent Rep. Jen Kiggans’ lead ahead of Democratic challenger Missy Cotter Smasal narrowed to a statistically insignificant 1 point, according to a new poll. Kiggans received 46% support among registered likely voters in Virginia’s 2nd Congressional District, while Smasal garnered 45%, according to a new poll by the Wason Center for Civic Leadership at Christopher Newport University. The Republican’s lead has tightened since the same poll in mid-September when Kiggans was 5 points ahead of Smasal. The margins of error for both polls were 3.9 percentage points. The district centered around Virginia Beach that includes Chesapeake, Suffolk, Isle of Wight and Virginia’s eastern shore is considered one of the most competitive in the state. Both Republicans and Democrats have cited it as among those critical to securing control of the House for the next two years. 2 SWING DISTRICTS IN NEW YORK SPLIT AS GOP INCUMBENTS FIGHT TO HOLD SEATS Home to the largest naval base in the country, the district’s voting population is heavily active duty and retired miliary, and both candidates are veterans. Of likely voters, 46% trusted Kiggans more to handle military and veteran’s issues, compared to 42% who trusted Smasal more, according to the poll. The poll found Smasal is trusted more, 49% to 35%, to handle “reproductive rights.” The district has flipped between red and blue twice already over the past six years. NEW JERSEY BATTLEGROUND HOUSE DISTRICT POLL FINDS TIGHT RACE AS GOP SEEKS TO RETAIN SEAT The poll showed Vice President Harris two points ahead of former President Trump among likely voters in Virginia’s 2nd Congressional District. FIRST ON FOX: Nearly 1 million illegal immigrants are staying in the U.S. “indefinitely” after their cases were dismissed or closed, or the Department of Homeland Security (DHS) failed to file the necessary documentation, according to a new House Judiciary Committee report being released on Thursday. “Through administrative maneuvering at both the Justice Department and DHS, the Biden-Harris Administration has already ensured that nearly 1 million illegal aliens can remain in the United States without the possibility of deportation—and that trend shows no sign of stopping,” the report by the House majority on the committee, first obtained by Fox News Digital, says. When illegal immigrants are encountered, they can be put into removal proceedings by which they will eventually face an immigration judge to have their case decided. There are around 700 immigration judges across the U.S., and they currently face a backlog of millions of cases after the historic crisis at the border. BIDEN ADMIN FACES SCRUTINY OVER RESPONSE TO ‘SIGNIFICANT RISE’ OF ASSAULTS ON BORDER PATROL AGENTS The report cites briefings to the committee, which staff say revealed that over 700,000 illegal immigrants have had their immigration cases dismissed, terminated or administratively closed in immigration court during the current administration, “allowing those aliens to stay in the country indefinitely without facing immigration consequences.” Additionally, it says that the Department of Justice’s Executive Office for Immigration Review (EOIR), which oversees immigration courts, reported over 109,000 cases as not adjudicated in FY 23, meaning they were completed but not adjudicated on the merits of the claims. Additionally, as previously reported, DHS has failed to file the necessary documentation for 200,000 additional cases, “meaning that the overwhelming majority of those aliens can also remain in the U.S. indefinitely.” “Instead of actually adjudicating illegal aliens’ cases based on the merits of aliens’ claims for relief—such as whether an alien has a valid and successful asylum claim—immigration judges under the Biden-Harris Administration have been tasked with rubberstamping case dismissals, case closures, and case terminations, all of which allow illegal aliens to remain in the United States without immigration consequences,” the report says. “This sort of quiet amnesty has become a staple of the Biden-Harris Administration’s immigration courts.” The report details that DHS issued a memo in 2022, directing Immigration and Customs Enforcement (ICE) attorneys to promote the closure and dismissal of cases, given the enormous backlog. It was framed as removing “nonpriority cases” from the docket — meaning those who do not qualify as national security, public safety or border security threats. WHAT VICE PRESIDENT HARRIS LEFT OUT ABOUT BIDEN ADMIN’S ROLE IN BORDER CRISIS: A TIMELINE Meanwhile, at the DOJ, the committee points to a 2021 memo issued by Attorney General Merrick Garland, in which he restored the use of a process known as administrative closure to allow a “focus on higher-priority cases.” The committee found, after interviews with officials including a former EOIR director, that immigration judges were encouraged to dismiss or administratively close cases. “In weaponizing both immigration judges within the Justice Department and ICE attorneys within DHS, the Biden-Harris Administration has guaranteed that upward of 1 million aliens—the overwhelming majority of whom likely would otherwise not have a legal basis to remain in the United States—can stay in the country indefinitely,” the report says. “This quiet amnesty not only undermines U.S. immigration law but also incentivizes additional illegal aliens to arrive at America’s borders, knowing they will be released into the country and never deported.” Fox previously reported that dismissing cases can also be problematic for migrants, who may be left in limbo as to their status and what to do next, as a dismissal does not grant a form of legal status either. The DOJ declined to comment, while DHS pointed to stats showing that 96% of notices to appear in court (NTAs) have been filed successfully since Jan 2021, and 98% since the start of FY 23, with the majority of new NTAs being filed digitally and automatically into EOIR systems. The DHS says that when an NTA is not filed correctly or late, the NTA is re-submitted so that the cases can continue at a later date. It stresses that migrants are also told to check in and report changes of address so they can continue to receive information about their cases. Meanwhile, the Biden administration has emphasized a sharp drop in encounters at the border since President Biden signed an executive order limiting entries into the U.S. Encounters are down 55% since then. The agency also says it has completed over 700,000 removals or returns for FY 24, the most since 2010. It comes as immigration remains a top election issue ahead of Nov. 5, with both former President Donald Trump and Vice President Kamala Harris dueling over who is the best candidate to tackle the situation at the border.
