‘Why now?’: Biden’s new immigration policy to limit asylum seekers faces quick criticism in Texas
President Joe Biden is expected to detail the executive order Tuesday afternoon. It would reportedly restrict the number of asylum seekers allowed to cross the border.
Johnson lays out strategy to crack down on DOJ ‘weaponization’ against Trump

House Speaker Mike Johnson, R-La., revealed a “three-pronged” strategy for cracking down on the alleged weaponization of the Department of Justice (DOJ) in a closed-door meeting with House Republicans on Tuesday. It comes as former President Trump faces criminal charges in two federal cases led by special counsel Jack Smith, as well as charges in Fulton County, Georgia, and a criminal conviction on 34 counts in Manhattan criminal court. Three people, two GOP lawmakers and a source familiar with the plan, told Fox News Digital that Johnson’s strategy to rein in the “weaponization” of the DOJ is broadly focused on three pillars: oversight, appropriations and legislation. Johnson updated Trump on the plan ahead of announcing it to his House GOP conference, Rep. Ronny Jackson, R-Texas, told Fox News Digital. TRUMP GUILTY ON ALL COUNTS IN NEW YORK CRIMINAL TRIAL Johnson confirmed his approach during a press conference just after the meeting. “We’re going to do everything we can, everything within our scope of our responsibility in the Congress, to address it appropriately. And I announced this morning to our conference, we’re working on a three-pronged approach,” Johnson told reporters. “We’re looking at various approaches to what can be done here through the appropriations process, through the legislative process, through bills that will be advancing through our committees and put on the floor for passage and through oversight. All those things will be happening vigorously.” WHAT’S NEXT FOR TRUMP LEGALLY? WHICH CASE MIGHT COME UP BEFORE ELECTION DAY? Rep. Ralph Norman, R-S.C., told Fox News Digital that he understood Johnson’s timeline for his strategy to include both the next six months, while the House GOP still holds its razor-thin majority, and next year, assuming they keep the chamber from flipping to Democratic control. Norman paraphrased Johnson’s message to Republicans, “It can’t just be words…It’s got to have some action to it, and that’s where legislation comes in. Meaningless resolutions…that’s words. You’ve got to go beyond that.” The South Carolina Republican said Johnson did not raise the issue of a President Biden impeachment, however, despite Rep. Marjorie Taylor Greene’s threats to force a vote on the matter. Jackson said Johnson also pointed out that the chairs of the relevant committees – like Oversight, Judiciary and Appropriations – were already exploring ways to crack down on the DOJ. “It’s not going to happen instantaneously. This stuff has to be put together and vetted by the conference and then put on the floor, so on and so forth,” Jackson said. “His point was, we’re doing everything we can.” He said Trump is “in the loop on what the plan for the House is.” NY V. TRUMP: HOUSE JUDICIARY INVESTIGATES BRAGG PROSECUTOR WHO HELD SENIOR ROLE IN BIDEN DOJ Jackson suggested Johnson was looking at a shorter timeline but said the speaker did not give specifics on the matter. “I know there are people that are anxious, myself included, to see something happen. So it’ll be soon,” Jackson said. Johnson’s comments come the same day that Attorney General Merrick Garland is on Capitol Hill testifying before the House GOP-led Judiciary Committee. McCarthy sidesteps question on Speaker Johnson’s leadership during Capitol Hill visit

Former Speaker Kevin McCarthy, R-Calif., offered mild praise for his successor on Tuesday during a rare appearance back on Capitol Hill. McCarthy told Fox News Digital he was in Washington for Monday night’s swearing-in of his former aide, newly minted Rep. Vince Fong, R-Calif., who won a tight race to replace him. McCarthy said he was also there for a press conference commemorating the 35th anniversary of the Tiananmen Square massacre. KEVIN MCCARTHY’S GHOST IS HAUNTING HOUSE GOP’S NEXT BIG LEGISLATIVE FIGHT When asked by another reporter whether he thought Speaker Mike Johnson, R-La., was doing a “good job,” McCarthy said, “Johnson is working as hard as he can.” McCarthy became the first House speaker in history to be ousted in the middle of a congressional term last October, when a group of eight House Republicans joined all Democrats in voting to remove him from power. He left Congress at the end of 2023. WHY MEMBERS OF CONGRESS DECIDE THEY ‘GOTTA GET OUT OF THIS PLACE’ Johnson was elected via a unanimous House GOP vote three weeks later after days of chaos and turmoil that paralyzed Congress. The Louisiana Republican survived a similar threat just last month in a push led by two of McCarthy’s top allies in the House, Reps. Marjorie Taylor Greene, R-Ga., and Thomas Massie, R-Ky. In that instance, dozens of Democrats joined Republicans to table Greene’s measure, known as a motion to vacate, which averted a House-wide vote on the ouster itself. NATIONAL SECURITY HAWKS WARN CONGRESS THROWING PENTAGON ‘UNDER THE BUS’ WITH ‘INADEQUATE’ SPENDING BUMP McCarthy appeared to take an indirect shot at Johnson over the bipartisan vote last month during an appearance on Politico’s “Power Play” podcast. “I couldn’t live with myself if I’d done a deal with Democrats,” McCarthy had said. “If you can’t sustain being speaker by your own majority, should you sustain it? No.” Fox News Digital reached out to Johnson’s office for comment.

Biden order to block most illegal immigrants when crossings surge, as election nears

The White House on Tuesday announced long-awaited executive actions to stop illegal immigrants at the southern border claiming asylum if crossings reach a certain level — a move coming just months before the November election and that could soon see a legal challenge from activists. President Biden is issuing a presidential proclamation that will temporarily suspend the entry of non-citizens across the southern border once the number of average border encounters exceeds 2,500 a day over seven days, officials said. That will stay in effect until 14 days after there has been a seven-day average of less than 1,500 encounters along the border. Officials said it would make it easier for immigration officers to quickly remove individuals who do not have a legal basis to remain in the U.S. In the last 24 hours at the border, sources tell Fox there were 5,200 encounters, and it has averaged over 5,000 every day for the past week. There were 179,725 encounters at the southern border in April, compared to 211,992 in April 2023, and 189,357 in March. While those numbers are lower than highs seen in 2022 and 2023, they still remain high compared to pre-2021 numbers. BIDEN EXPECTED TO ANNOUNCE BORDER ACTIONS AS POLITICAL HEAT INTENSIFIES AHEAD OF NOVEMBER ELECTION In doing so, Biden is drawing upon authorities under 212(f) and 215(a)of the Immigration and Nationality Act (INA) which allows presidents to suspend entry of certain categories of foreign nationals. The Trump administration used 212 (f) on a number of occasions, including for the travel ban from certain countries, but it was blocked by a legal challenge from applying it to the southern border. The order from President Biden includes a number of exceptions for those coming across the border. It will not apply to visa holders, unaccompanied children, victims of a “severe form” of trafficking, as well as those who face an acute medical emergency or an imminent threat to life or safety. It also does not apply to those seeking entry to the U.S. via ports of entry using the CBP One app — of which around 1,500 migrants are allowed in each day. It is expected to take place immediately, and will be accompanied by a joint rule restricting asylum eligibility during high border encounters that will be issued by the Departments of Justice and Homeland Security. It marks a significant move toward the right from the Biden administration. In 2021 the administration rolled back a series of Trump-era border protections, which critics say encouraged the historic migrant numbers that followed. There have been over 7 million migrant crossings during Biden’s time in office. The administration says it is dealing with a hemisphere-wide challenge that needs congressional action to provide funding and fix what it says is a “broken immigration system.” The White House has said that this action comes now after Republicans have rejected other attempts at congressional actions, including a bipartisan Senate bill that would have implemented a similar limiting mechanism as well as providing additional funding. “The presidential proclamation, together with the interim final rule, is another important step in our more than three years of ongoing efforts to strengthen our ability to impose consequences on those who cross our southern border,” a senior administration official told reporters on Tuesday ahead of the announcement. FOX NEWS POLL: VOTERS SAY THE US-MEXICO BORDER IS A BIG PROBLEM “But we are clear eyed that today’s executive actions are no substitute for Congress taking up and passing the tough but fair bipartisan Senate bill, which would have significantly strengthened the consequences in place at the border and, equally important, have provided billions of dollars to support the men and women who are working on the front lines to secure our border,” they said. While Republicans have previously urged the administration to use 212(f) to stop illegal crossings, ahead of the announcement lawmakers were unimpressed and called it a move that was too little, too late. “By my count, he’s issued 94 executive orders since he’s been president for the United States. But he’s waited until today to actually do what he calls effective action on the border,” Sen. John Cornyn, R-Texas, said at a press conference. “And my question to him is, why did you wait until now if you were serious about doing it? The simple answer is he’s not serious about securing the border.” Other lawmakers claimed it was a cynical move just months out from an election in which Biden is struggling due to his handling of border security. A recent Fox News poll found that seven in 10 voters go so far as to say the White House has “mostly failed” at improving border security. MAYORKAS SAYS SOME MIGRANTS ‘TRY TO GAME’ ASYLUM SYSTEM, AS BORDER REMAINS TOP POLITICAL ISSUE “It’s a little late, you can’t make this cat walk backwards,” said Sen. John Kennedy, R-La., who described Biden as “polling right up there with fungal infections.” The move comes with Biden facing intense political pressure on the crisis from both the left and the right. CLICK HERE FOR MORE COVERAGE OF THE BORDER SECURITY CRISIS Mayors of cities like New York City, Denver and Chicago have demanded more funding from the federal government and have called for additional action, including expedited work permits. Recently, 15 House Democrats wrote to Biden calling on him to take additional action at the southern border. “It has become clear that the current situation remains untenable, but with Republicans playing politics on border security, it is time for your administration to act. We urge you to use all tools at your disposal, including executive action, to better address security at the Southern border, interdict illicit fentanyl and allow for orderly legal immigration,” the letter said.
Illinois meeting probing ‘supermayor’ Tiffany Henyard’s lavish spending devolves into chaos

A meeting that involved addressing allegations of corruption and lavish spending against scandal-ridden “supermayor” Tiffany Henyard descended into chaos on Monday as her opponents and supporters clashed in Dolton, Illinois. The scuffle in the small town south of Chicago took place after Dolton trustees voted 4-2 to reinstate former Chicago Mayor Lori Lightfoot to investigate Henyard, who has been accused of using village funds as her own piggybank – billing taxpayers thousands of dollars for her hair and makeup team as well as going on a lavish trip to Las Vegas. Police had to break up the altercation, which almost came to blows, as Henyard and the trustees cleared the room. DOLTON BOARD MAKES NEW MOVE AGAINST SCANDAL-RIDDEN ‘SUPERMAYOR’ TIFFANY HENYARD The town had previously hired Lightfoot to look into Henyard, but the Dolton mayor, who previously insisted that “God chose me,” vetoed the move. Henyard also previously vetoed the board’s request to launch a federal investigation into gathering information on her alleged spending and finance mismanagement. “We are not going to allow anyone stop us or obstruct our ability to get to the facts,” Lightfoot said during the meeting, but she was being drowned out by Henyard and trustees who made several attempts to talk over her, Fox 32 Chicago reports. Lightfoot’s microphone was also turned off as she tried to speak, according to a report. The incident capped off more than two hours of heated debate when village residents packed the chamber to air their grievances against Henyard, blasting her apparent lack of transparency on the spending of village finances. “You’re not going to understand until they come and put cuffs on you,” resident Thelma Gant said, referring to a separate FBI probe. Henyard stared down and appeared to ignore most of the public commenters, Fox 32 reports. Afterward, Henyard blamed the media and what she sees as a political smear campaign for all the heat. DEMOCRATIC ILLINOIS ‘SUPER MAYOR’ VETOES ATTEMPT TO PROBE HER LAVISH SPENDING “You guys are following a fiction, a made-up story,” Henyard said into her golden microphone. Lightfoot has continued to work on the investigation, though she has yet to receive payment for her work, according to NBC Chicago. Her investigation is expected to be complete in 60 days, the outlet reports. Lightfoot was initially expected to be paid $400 an hour, but Henyard previously said she would not be paid. Henyard has drawn national attention to the small town which has a population of around 21,500. Dolton residents have already called for Henyard’s resignation and for her to be arrested. Earlier in the day, village officials blocked off the street in front of Village Hall, making residents park a block away and walk. “You made the elderly and the disabled walk here,” Gant said. “I hope you’re proud of yourself, Tiffany Henyard.” Henyard has been dubbed the “worst mayor in America” by critics after being accused of financial misdeeds as well as weaponizing police raids. Most recently, she has also come under fire for an alleged sexual assault by one of her allies during the Vegas trip, where the alleged victim claims to have been fired after speaking out. Henyard’s cancer charity is also facing scrutiny. Fox News Digital previously reported that Henyard has been living like a royal with a combined salary of nearly $300,000, more than the state’s governor, and frequent use of beauty vendors, despite the 23,000 residents of the Illinois town having a median income of $24,000. In April, the FBI served two federal subpoenas as part of an investigation. Henyard herself was not served. The first one was for employment records, personnel files and disciplinary reports for 25 Dolton employees, including three police officers and Keith Freeman, who is the village administrator and Henyard’s top aide. Freeman was charged with bankruptcy fraud. The second subpoena was served specifically on Freeman, asking for records of all companies associated with him and possible ties to the village. In February, it was reported that the FBI was investigating Henyard, as six individuals had reportedly spoken to the agency about her alleged misconduct, including “business owners, a former village employee and one or more public officials.” Last month, board members of Dolton appointed a mayor pro tempore to sign off on village business and pay bills as they said Henyard had missed 25 of the special meetings and refused to allow some business to be put on the agenda for the village’s regular meetings, Henyard has appealed to racial politics amid her scandals before, proclaiming during a previous meeting, “Y’all got false narratives out there, and y’all should be ashamed of y’all selves. Y’all Black. Y’all are Black! And y’all sitting up here beating and attacking on a Black woman that’s in power. Y’all should be ashamed of y’all selves.” Lightfoot later released a statement encouraging Heynard to cooperate with her investigation. “I commend the Village of Dolton Board of Trustees for decisively exercising their authority to override Mayor Henyard’s veto and preventing any attempts to stall an independent investigation into the matters outlined in the resolution,” the statement reads, in part. “They understand that village residents deserve a transparent and thorough process.”

More than 500 noncitizens registered to vote in DC Council elections Tuesday despite House reckoning

More than 500 noncitizens are registered to vote in Tuesday’s Washington, D.C., Council elections. As of May 29, which is the latest available count, 523 noncitizen Washington, D.C., residents are registered to vote, Sarah Graham, a spokeswoman for the District of Columbia Board of Elections (DCBOE), told Fox News Digital. That includes 310 registered Democrats, 28 Republicans, 16 with the D.C. Statehood Green Party, and 169 unaffiliated noncitizen voters who are registered with no party, Graham said. Graham said the DCBOE does not collect data on the nationalities of noncitizen voters, but The Washington Post spoke to noncitizen voters from El Salvador, Iran and Ethiopia. TOP DEM’S PAST PUSH FOR NONCITIZEN VOTING RIGHTS REVEALED AHEAD OF HOUSE VOTE Just days before the June 4 Washington, D.C., primary, 52 House Democrats voted with Republicans on a bill to overturn a 2022 Washington, D.C., law that allows noncitizens to vote in local elections. Though it is unclear if the Democrat-controlled Senate will take on the legislation, the margin of House Democrats who supported the bill increased from the 42 who voted to strike down the law last year. The House Administration Committee has held two hearings in recent weeks dedicated to discussing how noncitizen voting impacts confidence in American elections and risks possible foreign interference. “The D.C. Board of Elections recently confirmed that nearly 500 non-citizens have registered to vote in our nation’s capital, and that number is only growing. Early voting for D.C. primary election is happening right now. And as we sit here today, non-citizens are voting to elect members of the D.C. City Council. That’s absurd,” Chairman Bryan Steil, R-Wis., said during his opening statement last week. “We must do two things. One, we cannot allow the D.C. citizens voting law to spread across the United States,” he said. “And two, we need to ensure non-citizens aren’t voting in federal elections across the United States. While it’s illegal today for non-citizens to vote in our federal elections, it’s also illegal to evade border patrol and unlawfully enter the country. And as we’ve seen, that hasn’t stopped anyone.” During early voting for the D.C. Council primary, 6,051 people have already voted in person at polling sites across the district, 27,734 mail-in ballots have been received via the U.S. Postal Service and another 18,492 ballots have been received by drop box, according to the latest figures posted on the DCBOE website. DC CARJACKER CRASHES NEAR US ATTORNEY’S OFFICE, ELDERLY WOMAN INSIDE VEHICLE DIES: POLICE As of April 30, 450,750 people were registered to vote in the nation’s capital. The numbers are tallied monthly, so the latest data available is from April, Graham explained, since May ended four days ago, and the Washington, D.C., Council elections are happening Tuesday. Last year, Abel Amene, an Ethiopian immigrant, became the first noncitizen elected to public office in Washington, D.C. Amene ran unopposed as Ward 4’s advisory neighborhood commissioner. “I like to say that non-citizen voting is actually as American as apple pie. It’s been happening for centuries as part of the fabric of America,” Amene claimed in an interview with WUSA last week. “We pay taxes. I could be drafted, so I’m not really sure where the controversy is around. We can’t participate in federal elections. All we want to vote for is our ANCs and our council members.” Another noncitizen voter, Shaghayegh Chris Rostampour, who moved to the U.S. from Iran in 2018 for graduate school at Brandeis University, and then moved to Washington, D.C., for work after that, argued that illegal immigrants who register to vote in local elections wouldn’t take the risk of breaking the law to vote at the federal level. “A person who is either a student and on a visa or on a work visa, or is on the path to citizenship or has applied for asylum or is undocumented, wouldn’t really risk registering it when it’s illegal to vote in federal elections and risk, everything that they’ve done, risk, all the sacrifices that they’ve made to cast a vote a ballot that would not be counted,” Rostampour said in an interview with WUSA. At last week’s hearing, Steil argued that letting noncitizens vote in local elections will “continue to create challenges for states to maintain clean voter rolls.” The chairman said the committee discovered a week earlier that 137 noncitizens were on the voter roll in Ohio and cited how Virginia removed 1,481 noncitizens from their voter rolls in May 2023.
Biden calls Trump a ‘convicted felon’, says 2020 loss is ‘literally driving him crazy’

President Biden called former President Trump a “convicted felon” who “snapped” and is going “crazy” after the 2020 election at a campaign event Monday. The remarks at a fundraiser in Greenwich, Connecticut, were the first time Biden has participated in a campaign reception where he referred to his 2024 opponent as a “convicted felon.” “Folks, the campaign entered uncharted territory last week. For the first time in American history, a former president that is a convicted felon is now seeking the office of the presidency,” Biden said. “But as disturbing as that is, more damaging is the all-out assault Donald Trump is making on the American system of justice.” A jury found Trump guilty of 34 felony counts of falsifying business records in his New York criminal trial last week. Trump maintains his innocence and has claimed Biden and the Democratic Party prosecuted him for political purposes, to damage his presidential campaign. GARLAND TO PUSH BACK ON TRUMP’S ‘LOCKED & LOADED’ FBI CLAIM, DENY DOJ CONTROL OF NY CASE At the White House on Friday, Biden told reporters, “it’s reckless, it’s dangerous, it’s irresponsible for anyone to say this was rigged just because they don’t like the verdict.” He repeated those comments on Monday and suggested Trump is not mentally well. “Something snapped in this guy for real” after the 2020 election, Biden said. “It’s literally driving him crazy.” He told the audience Trump “does not deserve to be president whether or not I’m running.” Throughout most of Trump’s New York trial, Biden and his campaign held back from attacking the presumptive Republican nominee over his criminal charges. It appeared to be an effort to combat Trump’s repeated unsubstantiated allegations that it was a “SHAM TRIAL instigated and prosecuted directly from the inner halls of the White House and DOJ [Department of Justice].” FOX NEWS POWER RANKINGS: ALL EYES COULD BE ON OMAHA THIS NOVEMBER However, that changed last Tuesday when the Biden campaign held a news conference outside the courthouse in Lower Manhattan, which appeared to be a major break with their strategy during the past six weeks of steering clear of the case. Similar to what the Trump campaign had been doing for the duration of the trial, the Biden team came equipped with high-profile surrogates. They were actor and Biden supporter Robert De Niro, who last week voiced a campaign ad for the president, and former police officers Harry Dunn and Michael Fanone, who fought back against pro-Trump rioters during the Jan. 6, 2021, attack on the U.S. Capitol. Now, the president is openly calling his opponent a “convicted felon” and making the case that he is dangerous and unfit for office as such. TRUMP LEADS BIDEN ON MOST OF THE KEY ISSUES IN THE FIRST FOX NEWS POWER RANKINGS ISSUES TRACKER “Crooked Joe Biden will do anything to distract from Hunter’s trial and the fact his family has raked in tens of millions of dollars from China, Russia and Ukraine,” said Jason Miller, a senior advisor to the Trump campaign. “The Biden Family Criminal Empire is all coming to an end on November 5th, and never again will a Biden sell government access for personal profit.” Biden currently trails Trump both in national polling and in public opinion surveys in most of the crucial battleground states that will likely decide their election rematch. The Trump campaign and the Republican National Committee announced Monday they raised a stunning $141 million in May. The announcement came days after Trump and the RNC hauled in nearly $53 million in the first 24 hours after Trump’s guilty verdict. The Biden campaign is sitting on an $84 million war chest as of April. Fox News Digital’s Paul Steinhauser contributed to this update.
‘Remain vigilant’: Pence nonprofit urges conservatives not to ‘back away’ from these key policy victories

FIRST ON FOX: Advancing American Freedom, a nonprofit that advocates for conservative values and policy proposals, released a memo on Tuesday touting key “triumphs” from the 2020 RNC platform and encouraging conservatives to continue fighting to defend those key issues. “The 2016 Republican National Convention platform, retained in 2020, was the most principled conservative platform in nearly 40 years,” Advancing American Freedom, founded by former Vice President Mike Pence in 2021, says in Tuesday’s memo. “As always, liberal Republicans want to water down many of the Conservative Movements’ favorite planks. Grassroots conservatives must remain vigilant in defense of a strong conservative platform.” The memo outlines key points from the platform on abortion that calls for protecting “Human Dignity and the family.” MIKE PENCE ACCUSES BIDEN OF IMPEACHMENT HYPOCRISY AMID ISRAEL ARMS THREAT “We assert the sanctity of human life and affirm that the unborn child has a fundamental right to life which cannot be infringed,” the memo reads, adding that the Republican Party must continuee to “oppose the use of public funds to perform or promote abortion or to fund organizations, like Planned Parenthood, so long as they provide or refer for elective abortions or sell fetal body parts.” Republicans and pro-life groups helped successfully lobbied to overturn Roe v. Wade in 2022, marking one of the most consequential conservative political victories in decades, which Pence told Fox News in 2023 was a “new beginning for life.” US TROOPS COULD PAY PRICE IF NATO ALLIES DON’T MAKE MAJOR CHANGE, FORMER VP’S GROUP WARNS The memo also touches on IVF treatment and calls on Republicans to “oppose federal funding for harvesting embryos and call for a ban on human cloning.” “Marriage between one man and one woman is the foundation for a free society,” the memo states as a highlight from the 2020 platform. “We… condemn the Supreme Court’s lawless ruling in Obergefell v. Hodges.” The memo goes on to highlight conservative positions on “taxes and trade” as well as foreign policy. “Republicans consider the establishment of a pro-growth tax code a moral imperative,” the memo says. “We propose to level the international playing field by lowering the corporate tax rate to be on a par with, or below, the rates of other industrial nations.” The memo focuses on Ukraine, Israel and Taiwan when it comes to foreign policy, saying that conservatives “will not accept any territorial change in Eastern Europe imposed by force” when it comes to Ukraine while also reaffirming “unequivocal support for Israel and rejected two-state solutions.” “The United States… will help Taiwan defend itself against Chinese aggression,” the memo says. “As a loyal friend of America, Taiwan has merited our strong support, including free trade agreement status, the timely sale of defensive arms… and full participation in the World Health Organization… and other multilateral institutions.” Republicans will gather in mid-July in the key swing state of Wisconsin to hold their 2024 GOP Convention. “Time-honored principles that have delivered enormous prosperity for America should continue to drive policy as the platform articulated in 2016 and 2020,” said AAF Chairman Marc Short told Fox News Digital. “Some in the conservative movement are attempting to move away from these principles, instead chasing big government solutions that resemble the agenda of the left. Conservatives must not back away from what has created a winning agenda for the American people which is focusing on fiscal responsibility, a free economy, American leadership on the world stage, and defending family values, including the right to life.”
