Judge blocks NJ ballot design panned for alleged pro-establishment favoritism
A federal judge on Friday agreed to block New Jersey’s unique primary ballot design, which has been widely criticized as boosting the prospects of party-backed candidates. The judge acknowledged the extraordinary nature of the order and said the “integrity of the democratic practice” was at stake. The ruling shakes a foundational component of New Jersey’s primary election ballots, which in most of the state’s counties are designed by grouping the candidates with party support in a single column. That means the names of those running without establishment backing could be left in places on the ballot that are difficult to find. Opponents of the system argued it put a “thumb on the scale” for party-preferred candidates. The defendants in the suit — most of the state’s county clerks who design ballots — argued primarily that they didn’t have enough time to redesign the ballots. Andy Kim and two other candidates in the suit. “The Court wishes to make clear that it recognizes the magnitude of its decision. The integrity of the democratic process for a primary election is at stake and the remedy Plaintiffs are seeking is extraordinary,” Quraishi said. Kim called the ruling a victory in an emailed statement. An attorney representing a defendant declined to comment. Kim’s suit came amid a contentious primary contest against first lady Tammy Murphy in a race to succeed federally indicted U.S. Sen. Bob Menendez. The issue, for Kim, was that Murphy had won party leader backing in populous counties, meaning she would have had favorable ballot positioning. Murphy dropped out of the race on Sunday.
After judge’s scolding for playing ‘race card,’ Fani Willis says she’ll ‘talk about it anyway’
Embattled Fulton County, Georgia, District Attorney Fani Willis in a speech Friday seemed to defy a judge’s recent warning to not play “the race card,” insisting she’ll talk about race “anyway.” During her remarks at the South Fulton Women of the Shield Awards, Wills said that “it’s hard out here always having to prove yourself two and three times.” “Recently, they tell me they don’t like me to talk about race. Well, I’m going to talk about it anyway,” she remarked. Wills’ comments seemed to be in reference to the recent order by Judge Scott McAfee in which he said that her racially charged rhetoric of “playing the race card” was “legally improper.” JUDGE IN GEORGIA SLAMS FANI WILLIS’ ‘IMPROPER’ CHURCH SPEECH, ‘PLAYING THE RACE CARD’ McAfee’s comments were in his decision that said Willis could stay on the 2020 election interference case against former President Donald Trump if she removed special counsel Nathan Wade, with whom she was accused of having had an “improper” affair. Willis did not immediately respond to Fox News Digital’s request for comment. In his order, McAfee separately took issue with a speech made by Willis at an Atlanta church in January of this year, when she claimed she and Wade were being scrutinized because of their race. While Willis later claimed not to be referring to the defendants in her accusations of racism, McAfee warned that such a distinction was not clear. “In these public and televised comments, the District Attorney complained that a Fulton County Commissioner ‘and so many others’ questioned her decision to hire SADA Wade. When referring to her detractors throughout the speech, she frequently utilized the plural ‘they.’ The State argues the speech was not aimed at any of the Defendants in this case. Maybe so. But maybe not. Therein lies the danger of public comment by a prosecuting attorney,” McAfee wrote. The judge found that Willis’ reference to “so many others” in her speech at the church left ambiguous who she was accusing of racial motivations — coming dangerously close to compromising the case. Illegal migrant who went TikTok viral urging others to squat in people’s homes arrested by ICE
The Venezuelan illegal immigrant influencer who went viral with his TikTok videos urging other migrants to squat in people’s homes has been arrested by Immigration and Customs Enforcement (ICE) officials, Fox News has learned. Leonel Moreno was arrested by ICE’s Detroit field office and is now in federal custody, an ICE official told Fox News. He was caught by the agency’s fugitive ops team in Columbus, Ohio. Moreno had illegally entered the U.S. in April 2022, ICE confirmed to Fox News Digital Thursday. He was placed into the Alternatives to Detention (ATD) program by Border Patrol, but had absconded from the program after failing to report to an ICE office within 60 days of arriving at his destination. TIKTOKER GOES VIRAL EXPLAINING HOW ILLEGAL IMMIGRANTS TAKE ADVANTAGE OF SQUATTING LAWS Moreno had previously claimed his family is receiving $350 a week in government handouts and that he is making over $1,000 a day as a TikTok influencer. His account, which had over half a million followers, had gone inactive earlier this week, but his presence on Instagram remained. Moreno previously told his audience he planned to make a business out of “invading” abandoned houses and taking them over with squatters’ rights laws, then selling them for a profit. He claimed some of his African friends have told him they have already taken seven homes in the U.S. “I have thought about invading a house in the United States,” he said in the TikTok video. “I found out that there is a law that says that if a house is not inhabited, we can seize it.” He had also mocked people who work for a living. FREELOADING MIGRANT INFLUENCER MOCKS US TAXPAYERS WHO ‘WORK LIKE SLAVES’ WHILE WAVING CASH IN LATEST VIDEOS “You’re hurt because I make more than you without much work while you work like slaves, understand?” he said. “That’s the difference between you and me. I’m always going to make lots of money without much work, and you’re always going to be exploited and miserable and insignificant.” The U.S. is in the third year of a historic migrant crisis at the border, which has included a significant number of arrivals from Venezuala. Venezuelans are difficult to deport to their home country, however, since the socialist government is not taking them back after having started accepting deportation flights directly from the U.S. late last year. Only 834 Venezuelans were deported in fiscal year 2023, according to Immigration and Customs Enforcement (ICE) data, despite there being over 335,000 encounters at the border. Boston says it’s overrun by illegal immigrants, plans to place them in veterans housing
Boston is preparing to house illegal migrants in former veterans housing as the city’s resources have been exhausted since Democratic Gov. Maura Healey declared a state of emergency over the surge last summer. The Veterans Home at Chelsea will become a “safety-net site” for migrants where, beginning May 1, they will have to prove they are working to wean off government assistance by applying for work authorizations, learning English and searching for permanent residency. “We have said for months now that our system is at capacity, and we do not have the space, providers or funding to continue expanding,” Emergency Assistance Director Scott Rice said in a statement this week. “This new certification policy is a responsible step to address the capacity constraints at our safety-net sites. Families will need to demonstrate that they’ve taken action to get on a path toward independence and out of shelter.” MASSACHUSETTS CLOSES COMMUNITY CENTER TO PUBLIC TO SHELTER MIGRANTS, PROMPTING BACKLASH Healey’s office says the new requirements come as the state’s emergency family shelter system, which houses migrant families with children or homeless pregnant women, has been overwhelmed for months. According to the state’s website, the veterans home “offers residential and long-term care programs to eligible Massachusetts veterans.” Healey’s office said the site is vacant and slated to be demolished since the state reopened a larger center atop Powder Horn Hill in December. “Families will be permitted to remain at sites as long as they continue to engage these services and activities,” Healey’s office said in a news release Monday. TRENDY BOSTON WATERFRONT DISTRICT COULD GET NEW MIGRANT SHELTER AS ROXBURY MAXES OUT: REPORTS Jon Santiago, secretary of veterans services for Massachusetts, said, “This project operates independently and will not impact the daily routines or services at the Massachusetts Veterans Home at Chelsea.” There are 240 families living in the safety-net sites, while 7,500 families reside in the state’s emergency shelters. The migrant crisis has been complex for Massachusetts. The state’s newest emergency shelter, located in Roxbury, a neighborhood in Boston, reached its capacity of 400 people in just one week last month. New York City, Chicago and the state of New York all made emergency declarations last year and called for help in response to the migrant crisis. Another red state moves a step closer to enacting Texas-style anti-illegal immigration bill
Local police in Louisiana could soon be empowered to arrest persons suspected of being illegal immigrants under a bill moving through the state legislature. The bill, modeled after Texas’ anti-illegal immigration law, is one of a number of such bills under consideration in state capitals across the country. Senate Bill 388, introduced by GOP state Sen. Valarie Hodges, makes it a new crime for an illegal immigrant to enter or re-enter the state after having been deported. Violating the law is punishable by imprisonment of up to a year and a fine of up to $4,000. Louisiana’s governor would also be authorized to create an interstate compact with Texas to help control the “influx with respect to illegal immigration that consequently threatens the safety and security of Louisiana citizens.” SB 388 was approved by a Senate committee this week, and is expected to receive approval from the Republican-controlled legislature and governor. Hodges, a Republican, said the move is necessary due to the “open border” and inaction from the federal government. FORMER TOP ICE OFFICIAL SIDES WITH TEXAS GOV. ABBOTT OVER BIDEN IN ONGOING BORDER BATTLE “It’s something that I’ve been concerned about for several years,” she told Fox New Digital in an interview. “The fact that the federal government is not doing their job and they’re not protecting us.” Hodges compared the situation to protecting one’s home. “You don’t just let anybody come inside your house, and that’s what we’re doing at the border. We’re saying anybody and everybody come on in, and we’re finding out that there’s drug cartels, human trafficking cartels, trafficking children, women and men and boys with labor and sex trafficking,” she said, also noting captures of MS-13 gang members and people on the terrorist screening database. The effort comes as Texas’ version of the law, which was signed in December, is held up in the courts after a legal challenge from the Biden administration. It was briefly allowed to go into effect this month, but was then blocked again by the Fifth Circuit Court of Appeals. The administration says the Texas law, S.B. 4, interferes with enforcement of immigration laws, which is a federal responsibility. S.B. 4 is just another example of Republican officials politicizing the border while blocking real solutions,” White House press secretary Karine Jean-Pierre said in a statement this month. Other states have been making moves to copy Texas, meaning the ongoing legal battle could have direct impacts on their states, as well. Iowa recently sent a bill to Gov. Kim Reynolds’ desk, while similar proposals are moving forward in New Hampshire, Tennessee and Oklahoma. It reflects a growing frustration from states deeper in the interior about the effects that the now three-year border crisis is having on their states, including strain on social services, crime and other issues. The Biden administration has pushed for more funding and immigration reform, saying it is working within a broken system to tackle a hemisphere-wide crisis. Republicans argue that the crisis is the result of Biden-era policies. But while that battle rages on in Washington, D.C., states like Louisiana are taking matters into their own hands. Hodges, who says she is very confident the bill will be signed into law, said that states have a constitutional right to defend themselves. “Our Founding Fathers and our Constitution gave us that right, that if we are being invaded or we have imminent danger, our state’s rights supersede what the federal government is derelict in their duty to do,” she said. “And that was what motivated me to do this bill — because if they’re not going to do their job, we have to do it.”

Baltimore Key Bridge: House Republicans divided after Biden vows feds will foot the bill
House Republicans are divided over how to approach rebuilding the Francis Scott Key Bridge as federal and state officials race to assess the deadly collapse and make plans to restore the Port of Baltimore. A Singapore-linked container ship collided with the bridge early on Tuesday, sending the structure into the water. Officials have not given a timeline when they expect the Maryland port, one of the busiest on the East Coast, to reopen. President Biden vowed earlier this week that the federal government would foot the bill for reconstructing the bridge and called on Congress to back him up. Early reports have indicated it could cost as much as $2 billion. Rep. Andy Harris, R-Md., who along with the rest of Maryland’s congressional delegation is calling for federal support, also argued the private companies involved in the incident should make up the cost. US ARMY CORPS OF ENGINEERS SAYS IT’S ‘TOO EARLY’ TO KNOW BRIDGE DEBRIS CLEANUP TIMELINE “It was easy for the president to promise someone else’s money, American taxpayers’ money, but I think American taxpayers would kind of wish that he had the response he had after the East Palestine disaster, which is to call for the companies responsible to pay for the damages,” Harris told Fox News Digital, referencing last year’s toxic chemical train derailment in Ohio. He also noted that there is federal funding immediately available for situations such as this. The federal government approved $60 million in emergency dollars on Thursday. “We should actually be seeking to get money from those foreign companies… that operate the ship and chartered the ship,” Harris said. 2 BODIES RECOVERED FOLLOWING BALTIMORE BRIDGE COLLAPSE Another conservative, Rep. Ralph Norman, R-S.C., called Biden’s promise “absurd” and “idiotic” in a text message to Fox News Digital. Rep. Jeff Duncan, R-S.C., noted that the event was a “tragedy,” with six construction workers having lost their lives, but called on Biden to reallocate aid funds from his mammoth $1 trillion infrastructure law signed in 2021. “While I mourn the lives lost in Baltimore, we cannot haphazardly spend over $1 billion as America is $34 trillion in debt. Before we spend one more dime for domestic infrastructure, we must build a domestic border wall,” Duncan said. “Any funds used to rebuild the Francis Scott Key Bridge should be reprogrammed from Biden’s wasteful infrastructure bill.” It’s a sign that House GOP leaders could have some trouble navigating their razor-thin majority with a supplemental relief bill — though opposition will likely only go so far, with any measure expected to get broad bipartisan support. On the other hand, House Rules Committee Chair Tom Cole, R-Okla., who also chairs the House Appropriations Committee’s subcommittee on transportation, told Fox News Digital that he’s open to supporting federal funding. MARYLAND GOV. WES MOORE SAYS ‘THERE IS NOTHING WE WILL NOT DO’ ON RECOVERY EFFORTS “I’m not hostile to that at all,” Cole said of Biden’s vow, noting that the port’s closure affects the national economy. “I’ve learned more about the Port of Baltimore than I knew in the last 48 hours, in terms of how important it is… whether it’s moving automobiles through there, and moving agricultural — both exports and imports — in terms of supplies and machinery. It’s a very important facility, and it’s going to ripple through the national economy,” Cole explained. “I’m not going to quibble with the President of the United States over this…and certainly, Baltimore has every reason to expect a full and robust federal response.” Treasury Secretary Janet Yellen told MSNBC earlier this week that she expects insurance payments to cover some of the cost. But GOP Rep. Tim Burchett of Tennessee, who dealt with the after-effects of a tornado as mayor of Knox County, pointed out from experience that insurance payments take time to process. He told Fox News Digital he would keep “an open mind” about the federal government potentially paying the whole bill, if the insurance went to repayment later. “With insurance claims, it’s going to be a long, drawn-out process. If we had some agreement at some point that, you know, they would apply those funds back towards [the government], I wouldn’t have a problem with it,” Burchett said. “I believe it’s a federal highway. And so… it’s going to need to be addressed. It’s a huge detriment to those people.”
Chinese migrants make multi-country trek to US southern border: ‘I just want to make money’
FIRST ON FOX: Chinese migrants are making their way to the U.S. southern border in record numbers as part of a migration crisis of global proportions and are traveling through multiple countries to get there. So far in federal fiscal year 2024, which began Oct. 1, 2023, there have been over 22,000 migrant encounters of Chinese nationals at the southern border. That’s on pace to exceed the 24,314 encountered in fiscal 2023. That was a massive increase from the 2,176 encountered in fiscal 2022 and 450 encountered in fiscal 2021. Fox News spoke this month to a 36-year-old man from northern China who had traveled to Mexico with his wife and twin sons on their way to the U.S. CHINESE ILLEGAL IMMIGRATION ON PACE TO BREAK RECORDS AT US SOUTHERN BORDER His Douyin account, the Chinese version of TikTok, shows his family in China on the way to the airport. He says he has collected information online about a way to travel to the U.S., including information on routes, border navigation and how to dispose of information so one’s origin cannot be traced. People “vlog” about their journey on Chinese social media apps to get in contact with other Chinese nationals in the U.S. who can help find them jobs and a place to live. He says they left China in January and have traveled from China to Thailand (with a transfer in Bahrain) then going through Morocco (with a transfer in Spain), Ecuador, Colombia, Panama, Costa Rica, Nicaragua, Honduras, Guatemala and now into Mexico. So far, they’ve spent nearly $17,000 to make their way to the U.S. and are using a mix of cash, bank cards and app-based payments. Unlike many migrants, who will pay smugglers to guide them, this migrant designed all the routes himself, including through dangerous rainforests. “The Mexican Immigration Bureau has been very strict these days,” he said. “Spending money may not solve the problem, but fortunately, I have two children, and they actually take much better care of children and women.” CHINESE MIGRANTS POURING ACROSS SOUTHERN BORDER SPARK NATIONAL SECURITY CONCERNS Some migrants have been pictured expressing support for President Biden, while Republicans have accused the administration of encouraging the flow with its reversal of Trump-era policies, a claim the administration has rejected. But the migrant Fox spoke to expressed indifference about who is running the country. Migrants have different motivations for going to the U.S., some for more political or religious freedom, some because the U.S. offers benefits like health care, while others travel to America because they have lost faith in the Chinese economic recovery. “No matter whether it is Trump or Biden, we just wanted to come to the United States. I am not worried about my legal identity problem, because as long as we arrive in the United States, there will always be a way to solve the identity problem. We want to go to the United States mainly for our children and to give them a better future.” There are risks not only on the journey but even in China. One can be detained and fined nearly $1,500 for obtaining fraudulent travel documents.
